Terms of Service

You must be able to enter a binding contract where you live. If you permit a minor to use the Services, you are responsible for that use. You may not use the Services for an unlawful or unauthorized purpose, interfere with their operation or security, introduce malicious code, scrape or harvest information without permission, impersonate another person, or violate another person's rights.

Many products are pre-owned or one of one. We make reasonable efforts to describe each item's condition, measurements, included accessories, color, and visible wear accurately using photographs of the actual item. Device displays can render colors differently, and measurements are approximate. Normal pre-owned wear is not a manufacturing defect.

Product availability, descriptions, and pricing may change without notice. We may limit quantities or stop offering a product. Nothing on the Services is an offer where prohibited by law.

Products represented as Entrupy authenticated include the authentication support described on their product pages and in our Authenticity information. Other products are covered only by the representations expressly made on their individual pages. Brand names and trademarks belong to their respective owners. Gaby's Bags is an independent reseller and is not affiliated with, endorsed by, or sponsored by the brands whose products appear on the Services.

An order is an offer to purchase. We may accept, decline, hold, or cancel an order, including because an item sold elsewhere, inventory or pricing was incorrect, payment was not authorized, or fraud review could not be completed. If we cancel after payment, we will refund the amount collected for the canceled item.

You agree to provide current, complete, and accurate order, billing, and contact information and confirm that you are authorized to use the selected payment method. Prices are shown in U.S. dollars unless stated otherwise. Taxes, shipping, duties, or other charges are shown where applicable before purchase.

Shopify powers our ecommerce checkout. Payment, installment, wallet, and financing options may be provided by third parties such as Shop Pay or Afterpay and are subject to the provider's terms and eligibility rules. We do not control approval decisions, installment schedules, or separate provider services.

Our Shipping Policy, Returns Policy, and Store Policies are incorporated into these Terms. Review them before purchasing. Nothing in those policies limits rights that cannot lawfully be waived.

If you submit a review, photograph, comment, suggestion, or other content, you represent that you have the right to submit it and that it is accurate and lawful. You grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, format, and display that content in connection with the Services and our marketing. We may moderate or remove content, but we are not obligated to do so. Do not submit private or confidential information in public content.

The Services and their original text, design, photographs, graphics, logos, and other content are owned by or licensed to Gaby's Bags and protected by applicable law. Except for normal personal shopping use, you may not copy, reproduce, republish, distribute, modify, sell, or exploit our content without written permission.

The Services may include links, integrations, or tools operated by third parties. We do not control those services and are not responsible for their content, availability, privacy practices, or separate transactions. Review the third party's terms before using its service.

Our collection and handling of personal information is described in the Privacy Policy.

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We do not promise uninterrupted or error-free access. Except for express product promises and warranties that cannot legally be excluded, we disclaim implied warranties to the maximum extent permitted by applicable law. Some jurisdictions do not permit certain exclusions, so they may not apply to you.

To the fullest extent permitted by law, Gaby's Bags and its personnel and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Services. Where liability cannot be excluded, it will be limited to the maximum extent permitted by law. These limits do not apply to liability that applicable law does not allow us to limit.

To the extent permitted by law, you agree to defend and indemnify Gaby's Bags from third-party claims, liabilities, and reasonable costs arising from your unlawful use of the Services, violation of these Terms, or infringement of another person's rights.

We may update the Services and these Terms. Material changes will be posted with a revised date and any notice required by law. Changes apply prospectively when posted unless stated otherwise. We may suspend or terminate access for conduct that violates these Terms, creates risk, or is unlawful. Provisions that by their nature should survive termination will survive.

• These Terms are governed by the laws of Florida and applicable federal law, without regard to conflict-of-law principles, except where the law where you live requires otherwise.
• If a provision is unlawful or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect.
• Our failure to enforce a provision is not a waiver of that provision.
• These Terms and the policies incorporated by reference constitute the agreement regarding the Services and supersede prior versions on that subject.
